5 Things to Know Before Filing for Divorce in Cambodia
Divorce is never an easy decision, and the process can be confusing—especially if you’re unsure about your legal rights. If you're considering filing for divorce in Cambodia, here are five key things you need to know before taking the first step.
1. Divorce Is Legal in Cambodia for Both Civil and Religious Marriages
In Cambodia, both civil and traditional (religious) marriages are recognized under the law. A divorce must be filed with the court to be legally valid, even if the marriage was originally conducted through religious or traditional ceremonies.
Tip: A verbal or community separation does not count as a legal divorce.
2. 🏛️ You Must File in the Proper Court
Divorce cases are handled by the Municipal or Provincial Court where either spouse resides. If you are living in Phnom Penh, for example, your divorce would be handled by the Phnom Penh Municipal Court.
3. ⚖️ Grounds for Divorce Include More Than Just Infidelity
Under Cambodian law (Civil Code, Article 978), there are several accepted grounds for divorce, including:
- Mutual agreement
- Cruelty or abuse
- Desertion for more than one year
- Adultery
- Serious incompatibility or conflict
📌 If both spouses agree to the divorce, the process is faster and more straightforward.
4. 👶 Child Custody and Support Are Decided Based on the Child’s Best Interests
If there are children involved, the court will determine:
- Who will have custody
- How much child support must be paid
- Visitation rights for the non-custodial parent
The court prioritizes the well-being of the child, not just the financial position of the parents.
5. 💼 You Should Hire a Lawyer—Even for an “Easy” Divorce
While it is possible to file for divorce without a lawyer, the process includes:
- Filing the correct documents
- Attending court hearings
- Negotiating property, custody, and support
A qualified Cambodian divorce lawyer can protect your rights, help you reach a fair agreement, and avoid costly delays.
